Meal & Rest Breaks
SUMMER HOURS
The Chico campus will once again be observing summer hours for the summer of 2008 from May 26 - August 15. This schedule consists of 9-hour days, Monday-Thursday, with 4 hours worked on Friday. Because the Foundation is subject to a different set of labor laws than are State employees, this type of schedule requires the payment of overtime pay rates (time and one-half) For the 9th hour worked Monday-Thursday, for all non-exempt (hourly) employees.
Please make note that ANY hours worked by a non-exempt employee in excess of 8 in any day or 40 in any work week will be subject to the usual overtime payment laws. For benefited employees, holidays that fall within this time period will be paid at 8 hours per day (100% time employee), or the appropriate pro-rated amount for less than 100% FTE.

MEAL BREAKS
Please note that labor laws REQUIRE that an employee who works more than a 5-hour shift must have a minimum of a ½ hour meal break. (The exception is if the work shift is only six hours, then both the employee and employer may mutually agree to waive the meal period.) When hourly timesheets are completed, the timesheet must accurately reflect the receipt of the meal period by showing the appropriate “in” and “out” times. Employees working more than 10 hours require a second meal break.
If you have any employee working more than 5 hours but less than six hours in a day who wishes to waive his/her right to a meal break, a Meal Break Waiver form can be found on our website at www.csuchico.edu/rfdn under Forms and in the Supervisor’s section.
There are some positions that, because of the nature of the position and responsibilities, require an “On Duty” meal break (e.g., positions with oversight responsibilities of minor children). If you believe this to be the case for employees you supervise, please contact Foundation HR for review of this situation and to obtain the appropriate form.
REST BREAKS
In addition, labor law requires that employees must be given a paid rest break of not less than 10 consecutive minutes for each four hours (or major portion thereof) worked. Foundation policy allows for 15-minute break periods. Break times are NOT marked on timesheets, but MUST be observed in practice.
