Project Director Advisories

May 8, 2009 Project Director Advisory - Foundation Payroll and the Campus Summer Schedule of 4/10s.

In light of the campus decision to move to a 4/10 schedule for the summer months and questions regarding Foundation employees, it is necessary to remind all Project Directors and Supervisors of some of the basic labor law rules that are in place. It is important to understand that Foundation employees fall under a separate set of labor laws than do State employees which is why these differences exist.

1. Overtime pay MUST be paid to any non-exempt (hourly paid) Foundation employee whose work day exceeds 8 hours in any day or 40 hours in any week.

2. Foundation employees must receive a minimum of a half hour meal break for every work period of more than five hours. If their work day is complete at 6 hours, the employee may voluntarily choose to not take the meal break. In no case may an employee work more than six hours without the meal break.
PLEASE NOTE: ANY EMPLOYEE WHOSE TIMESHEET INDICATES HOURS WORKED IN EXCESS OF 6 THAT DOES NOT INDICATE A MEAL PERIOD TAKEN WILL RECEIVE ONE ADDITIONAL HOUR OF PAY AT THEIR REGULAR RATE.

3. Labor law requires a minimum of a 10-minute rest break for each four hours worked occurring as near to the middle of the work period as possible. This rest break must be authorized and permitted. If an employee freely chooses without coercion or encouragement to forego the rest period there will be no penalty.

4. Foundation employees are NOT eligible for compensatory time off (CTO). By law, a non-exempt employee must be paid for every hour worked in accordance with the rules above.
