Subject: Campus Equity Council Replaces EM 06-001 and EM 06-038

PREAMBLE

Upon the recommendation of the Academic Senate, and after consultation with Cabinet, the Campus Equity Council is constituted.

CHARGE

The Campus Equity Council will serve as an advisory committee that reports annually to the Academic Senate. One purpose of the Council is to aid in the implementation of EO 927. EO 927 “broadens the scope of what was once the CSU's sexual harassment policy to one that prohibits unlawful harassment based on any statutory category protected by the Fair Employment and Housing Act.” EO 927 “reemphasizes the importance of training the CSU community on anti-harassment and anti-retaliation policies and procedures in order to prevent and correct harassment.”

The Campus Equity Council’s charge will focus on preventing and correcting unlawful harassment and/or retaliatory acts involving employees, applicants, and independent contractors based on the statutory categories identified by the Fair Employment and Housing Act (i.e., race, color, religion, national origin, ancestry, gender identity and/or expression, sexual orientation, marital status, pregnancy, age, physical disability, mental disability, medical condition, and covered veteran status) through education and other outreach efforts. The Council will also focus on preventing and correcting unlawful harassment and/or retaliatory acts involving administrators, faculty, staff, students, and other members of the campus community (such as guests, vendors, volunteers) who may be covered by the campus Policy on Sexual Harassment (EM 99-020) or other State or Federal laws and regulations. Additionally, the Council will focus on education and outreach efforts on anti-retaliation policies and procedures.

The Campus Equity Council will promote equal opportunity in education and employment by reviewing policies, procedures, reports, and practices that address illegal discrimination, harassment, and other barriers to equal opportunity in education and employment. The Council will make recommendations to the Academic Senate, The President’s Diversity Council, Human Resources, and Academic Personnel.

The Council will not be involved in receiving informal or formal complaints/grievances, investigating such complaints/grievances, or developing resolutions thereto.

Responsibilities of the Council include but are not limited to:

  • recommending revisions to anti-harassment and anti-retaliation policies and procedures;
  • increasing awareness of the University’s anti-harassment and anti-retaliation policies and procedures through on-going education and outreach efforts (e.g., training programs, workshops, speakers, conferences, publications);
  • partnering with other campus and community organizations to identify potential problems and proactively address all forms of harassment and retaliation;
  • providing a forum to discuss general campus harassment and retaliation issues and concerns (excluding personal complaints);
  • assessing the campus climate and the efficacy of anti-harassment and anti-retaliation policies and procedures;
  • addressing other issues related to management/employee/student relations (e.g., hostile work environment);
  • review and recommend policies and practices intending to
  1. provide equal opportunity in education and employment
  2. prohibit the occurrence of unlawful discrimination in education and employment based on age, ancestry, race, religion, color, national origin, gender identity and/or expression, sexual orientation, marital or veteran status, pregnancy, and physical or mental impairment.

TYPE

The Campus Equity Council is a permanent committee as authorized by Article VI. Section 2 of the Academic Senate Constitution.

REPORTING RELATIONSHIP

The Campus Equity Council reports to the Faculty and Student Policies (FASP) Committee of the Academic Senate and to the President. The Committee will provide a report in the spring semester.

      • Associate Vice President for Academic Personnel
      • Assistant Vice President for Staff Human Resources
      • Chief of University Police Department or Designee
    • One-year term:One student representative appointed by the Associated Students
    • Two-year staggered terms:
      • One representative appointed by the Medical Chief of Staff
      • One representative appointed by the Director of Student Judicial Affairs
      • One representative appointed by the Director of University Housing and Food Service
      • One representative appointed by the Director of Accessibility Resource Center
      • One faculty, who is a FASP member appointed by the Senate Executive Committee
      • One staff, who is a FASP member appointed by the Senate Executive Committee
      • One dean appointed by the Provost
  • Officers: The Chair, Vice Chair, and Secretary will be elected by the Committee.
  • First Meeting: The Chief Diversity Officer or designee will call the first meeting in September. At its first meeting, the council will determine how the staggered terms will be allocated.
