For Facilities Use Agreements

  • General Liability: comprehensive or commercial form minimum limits each occurrence $1,000,000, General Aggregate $2,000,000.
  • Employer Liability:  $1,000,000.
  • Business Automobile Liability:  minimum limits for Owned, Scheduled, Non-Owned, or Hired Automobiles with a combined single limit of not less than $1,000,000 per occurrence.
  • Workers' Compensation: as required under California law.
  • Hold Harmless Provision: Lessee shall hold harmless, indemnify, and defend the State of California, the Trustees of The California State University, California State University, Chico; Chico State Enterprises and the officers, employees, volunteers and agents of each of them from and against any and all liability, loss, damage, expense, costs of every nature, and causes of actions arising out of or in connection with the use by the Lessee of said property.

Long-term leases of real property require case-by-case analysis to determine insurance requirements and will vary depending on the nature of the agreement.  Insurance requirements should be commensurate with the activities associated with the lease that may cause damage to person or property.

Evidence of Adequate Coverage - Insurance Requirements

Evidence of adequate insurance coverage is required by furnishing to the University a certificate of insurance that includes an additional insured endorsement and each insurer shall have an A.M. Best (or equivalent) rating of at least A:VII unless otherwise agreed to by the University.

An additional insured endorsement must accompany each certificate (workers' compensation excepted).

The standard insurance form #CG 20 10 10 01 is accepted.

Endorsement is to be on a separate page and the wording on the endorsement is to be exactly as follows:

The State of California; the Trustees of The California State University; California State University, Chico; California State University, Chico State Enterprises; and the officers, employees, volunteers and agents of each of them are included as additional insured's.

OTHER REQUIREMENTS:
1. Each insurer shall have an A.M. Best (or equivalent) rating of at least A:VII unless otherwise agreed to by the University.

2. Certificates of insurance and policy endorsements may be e-mailed to: risk@csuchico.edu or faxed to: 530-898-4513.

3. Certificates of insurance and policy endorsements must be approved by the University prior to commencement of services by the Contractor/Vendor.

4. The Contractor/Vendor’s insurance coverage shall be primary. The self-insurance maintained by the University, the Trustees of the California State University and the officers, employees, or volunteers of each shall be in excess of the Contractor/Vendor’s insurance and shall not contribute with it.

5. Coverage shall not be cancelled, modified, or reduced without thirty (30) days advance written notice to the University.

Applicability of Insurance Requirements

These requirements apply to recognized University, University auxiliary, student, and outside organizations. University auxiliary organizations may submit evidence of insurance coverage annually at policy renewal time.  All other organizations shall submit such evidence with each request for facilities use, unless the Facilities Reservations Coordinator finds it expedient to secure evidence annually.

Facilities Reservations coordinates the reservations of general-use lecture rooms, conference rooms, auditoriums and theater space, athletic facilities, recreation or outdoor spaces, and specialty use spaces.  Contact Facilities Reservations at fres@csuchico.edu
